CPSIA, U.S. Consumer Product Safety Improvement Act
On August 14, 2008, ;The Consumer Product Safety Improvement Act (CPSIA/HR4040) was officially signed and enacted as law by the United States Congress. This Act is the most important and influential Consumer Protection Act since the establishment of the Consumer Product Safety Commission (CPSC) in 1972. In the new bill, there are more stringent requirements on lead content in children's products, and also new requirements on harmful substances, such as a ban of certain phthalates in toys and childcare articles. In addition, the bill also requires the establishment of a common consumer product safety database.
CPSIA affects all U.S. production, imports, distribution of toys, clothing, and other children's products and childcare-related industries. Before all products are released for commerce to the U.S. market, safety testing by an approved third-party testing laboratory recognized by U.S. Consumer Product Safety Commission CPSC, is required or one must face hefty fines and disruption to product sales.
Under the new bill, third-party testing and certification of children's products has been gradually introduced and reinforced. The Bill also requires the U.S. Consumer Product Safety Commission to announce different types of accreditation scopes for testing different children's products. Once the Commission publishes the testing requirements for a category of children's product, that category must then be tested in accordance with the current requirements within 90 days after the effective publication date.
